Insurance Fraud Reasoning

  1. Alan Simon was an insider at Mosler Automotive, managing EPA certifications.
  2. Alan Simon managed the EPA Certification of the 2004 Mosler MT900s.
  3. Alan Simon knew that the MT900s vehicles were all built illegally, and should never be insured for road use.
  4. Alan Simon was involved in the decision NOT to RECALL the seventeen MT900s vehicles after three of them had fuel lines come loose & one previous fire.

Alan Simon was 100% aware that his car was illegal to drive on public roads.

  1. 2008: For tax purposes, Alan Simon was given a 2004 Mosler MT900s by Warren Mosler.  Alan Simon did pay $11,500 for various options: this is the total $ paid.  The list price on the gifted vehicle was $189,900.
  2. The 2004 Mosler MT900s was built illegally, as detailed in the Alan Simon Insurance Fraud Case:
    1. The car was built in late 2008, more than 3 years after the EPA Certificate of Conformity had expired.  The car is explicitly illegal due to element.
    2. The car had a lightweight flywheel, which was explicitly disallowed by CARB.
    3. The car was built with ultralight/high-flow headers & catalysts instead of the EPA-required    and emissions/durability-tested General Motors heavy manifolds & catalysts.
  3. 2009 – 2010:  Out of 25 MT900s vehicles worldwide, 3 had fuel lines come loose and    one of these resulted in an engine bay fire.  I urged Warren Mosler & Alan Simon to  recall the cars, because carbon-fiber is highly flammable and an engine bay fire could result in deaths.  My request was rebuffed by Alan Simon.
  4. October 2011: Alan Simon’s illegally-built 2004 MT900s had a ‘mysterious’ engine bay  fire and burned to the ground.
    1. Alan Simon sent me an email of a photo that his wife, Jeanne Simon had taken of the burned vehicle.

Insurance Fraud Timeline (con’t)

Alan Simon was 100% aware that his car was illegal to drive on public roads.

  1. Oct 3, 2011: My company, Supercar Engineering, was a distributor of Mosler products (at the time I had been deceived into believing the cars were legal).  Alan Simon sent me several photos of his burned MT900s, and followed-up with a phone call.
  2. Oct 3, 2011: Alan introduced himself and told me about how his MT900s had burned to the ground. Alan then told me that he was going to have the insurance adjuster call me about the value of the car. Alan then (without any hint of shyness) gave me instructions on how to justify the insurance fraud payout in the Alan Simon Insurance Fraud Case: “Tell them the list price is $329,000; my car was built near 2009, so this is reasonable. If they ask, tell them there are no substitutes available and that the factory isn’t building the cars anymoreIt was crystal-clear to me that Alan Simon was attempting to recruit me into an insurance fraud.
  3. Mid Oct 2011:  The Insurance Adjuster called me and asked about the value of the car.  I DIDN’T do as Alan Simon instructed, but instead informed the Insurance Adjuster of one similar sale at $180,000 for a 2004 MT900s and a $190,000 auction bid on a 2009 car.
    1. the 2009 MT900s is vastly superior to the 2004 MT900s; as Alan Simon knows.
  4. Oct 18, 2011: Alan Simon called me SCREAMING, “I ONLY GOT $190,000. This insurance case involved one of the few Mosler MT900s car insurance claims. They said it was a distributor from Connecticut; and you have a Connecticut phone number, so I know it was you!” I was incredulous…Alan Simon obviously expected the $130,000 OVER his car’s MSRP that his instructions would have yielded for him.
  5. November 2011 through April 2012: Not being content for 100% of MSRP for a 7-model-years-old vehicle with 5800miles; Alan Simon continued negotiating and apparently used a 2009 MT900s distributor invoice to get 105% of 2004 MSRP!!
    1. Although the list price for the 2009 model was higher, this was part of the Alan Simon insurance fraud negotiations.
  6. Late April 2012:  Alan Simon was awarded $200,000 + taxes (6% in FL).
    1. Alan Simon received approx. $212,000 for a car that he paid $11,500 for and illegally registered, illegally insured, and (likely) Alan Simon improperly withheld his foreknowledge about the severe fire risk.
  7. May 2, 2012: I begin getting emails from Alan Simon about his burned 2004 MT900s attempting to explain away the insurance fraud.  The emails are being submitted in conjunction with an attempt to shift the liability associated with the insurance fraud onto the prospective buyers of Mosler Automotive.
    1. I have attempted to get the name of Alan Simon’s Insurance Company from both Alan Simon and Warren Mosler over the past few years…and am being stonewalled.
  8. March 10, 2016:  This is when I FIRST DISCOVERED that I had been lied to all along about the Insurance Fraud being a legitimate claim.  After a deposition of Warren Mosler, Mr. Mosler stated something that cause me to make a request of the EPA; and on March 10th I discovered that it was DEFNITIVELY Insurance Fraud.

Evidence of Premeditated Insurance Fraud

  1. Letter from the Environmental Protection Agency to Wagner in response to Wagner’s Feb 17, 2016 inquiry into Mosler’s Certificates of Conformity (Exhibit 1).
    1. The few Certificates that Mosler Automotive purchased were for less than 1% of the time it was building cars. Alan Simon managed this portion of the ‘business’; was the disclosed to the Insurer??? If it had been, they would not have paid…certainly not MORE THAN MSRP.
    2. IMPORTANT NOTE: Definitive discovery of the crime occurred March 3, 2016; when Wagner received this letter from the Environmental Protection Agency confirming Wagner’s suspicions that the 2004 Mosler MT900s vehicles had all been built illegally, and Alan Simon knew his car should never have been registered and insured for public roads.

The 2004 EPA Certificate confirms the illegally built Mosler MT900s cars prior to January 1, 2005.

‘Consulier Industries’ DBA Mosler Automotive could not legally build cars in 2005, 2006, 2007, & 2008.  Alan Simon was responsible for these Certificates of Conformity, and was aware that they were being built illegally.

    1. Shows the burned car, as a primer for the subsequent phone call from Alan.

Phone records showing phone calls from Alan Simon to Wagner on Oct 3, 2011 to recruit Wagner for the insurance fraud and Oct 18, 2011 to punish Wagner for not complying with the fraudulent instructions that would have netted an extra $130,000 of insurance fraud payout for Alan Simon (Exhibit 3).

  1. Email dated May 2, 2012 where Alan Simon implies that he did NOT disclose to the Insurance Company’s fire investigator that he knew the source of the fire (Exhibit 4).

The list price for the 2004 Mosler MT900s vehicles was $189,900. Alan Simon was given $200,000 + 6% taxes (total $212,000) even though the vehicle had 7800 miles and was 7 model years old (3 actual years). Alan Simon used Mike Vietro wholesale invoices for the 2009 cars ($229,000) as the reference in order to obtain the above-MSRP payout.

  1. The Mosler Automotive Manufacturer’s Recall for the fuel lines, which was sent out IMMEDATELY AFTER Alan Simon received the insurance payout (Exhibit 6).
    1. Mosler Automotive would not have done this Recall if there were only one fire; this was the FOURTH incident. Warren Mosler held this Recall until AFTER Alan Simon got his payout.

    1. The 2004 MT900s vehicles are illegal because they were all built after the EPA Certificate of Conformity had expired AND they were all built with illegal, lightweight, high-flow catalysts.
    2. Alan Simon’s car was built in 2008 – more than 3 years after the EPA-mandate that Mosler Automotive cease building road cars.
